Pixel Proxy — Terms of Use (EULA)

1. Acceptance of the Terms

By downloading, installing, or using the Pixel Proxy mobile/desktop application (the “App”), you agree to these Terms of Use (the “Terms”). If you do not agree, do not use the App.

2. Description of the Service

Pixel Proxy is a network utility that enables connections to virtual private networks (VPN). Pixel Proxy is not an internet service provider or a telecommunications carrier and does not control third-party networks or websites. The App does not provide emergency services.

3. Privacy

Your use of the App is also governed by our Privacy Policy (available in the App and on the App Store listing). We do not log traffic contents, browsing history, DNS queries, destination IPs, or source IPs associated with your VPN sessions. 4. No-Logging Commitment (Summary)

We do not collect or store: (i) your browsing history or traffic content; (ii) DNS queries; (iii) destination addresses accessed via the VPN; or (iv) source IP addresses or connection timestamps tied to your VPN sessions. Diagnostic and advertising data may be processed as described in the Privacy Policy.

5. Third-Party Services & Advertising

The App may integrate third-party SDKs (e.g., advertising via Appodeal) for ad delivery/measurement, fraud prevention, and analytics. Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party content or services.

6. Acceptable Use

You agree not to use the App:

• for unlawful activities or violations of third-party rights (including intellectual property);

• to distribute malware, operate botnets, host phishing, spread spam or deceptive/false content;

• to attack networks or services or disrupt App operation (e.g., DDoS, port scanning, credential stuffing);

• for fraudulent schemes or to obtain funds or data by deception;

• to impersonate any person or entity or to incite or facilitate illegal acts.

You are solely responsible for your conduct and compliance with applicable laws and regulations.

7. Accounts and Access

The App may be usable without an account. If an account or credentials are introduced, you are responsible for maintaining their confidentiality and for all activities under your access.

8. Subscriptions & Billing (if applicable)

If the App offers paid plans or auto-renewing subscriptions purchased through Apple:

• Payment is charged to your Apple ID upon confirmation of purchase.

• Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period.

• Your account is charged for renewal within 24 hours before the period ends.

• Manage/cancel in Settings → [your name] → Subscriptions on your device after purchase.

• Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription.

9. Software License

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for lawful purposes. You may not copy, modify, reverse engineer, decompile, attempt to derive source code (except as permitted by law), sell, sublicense, or distribute the App.

10. Updates & Changes

We may update the App (including automatically) and modify these Terms. The current version will be available in the App and on the App Store listing. Continued use after changes take effect constitutes acceptance.

11. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that the App will be error-free, secure, uninterrupted, or meet your requirements, or that VPN connections will be available in all locations or at all times.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, LICENSORS, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP OR, IF NONE, USD $10. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES, THE ABOVE LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED.

13. Indemnification

You agree to indemnify and hold harmless Pixel Proxy, its affiliates, officers, employees, and partners from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any law or third-party right.

14. Suspension & Termination

We may suspend or terminate your access to the App at any time, with or without notice, if we reasonably believe you have violated these Terms, pose a security or legal risk, or for technical/operational reasons. Upon termination, your license ends and you must cease using and uninstall the App.

15. Apple App Store Terms (iOS/macOS)

If you obtained the App via Apple’s App Store:

• These Terms are between you and us; Apple is not a party.

• We, not Apple, are solely responsible for the App and its content, maintenance, and support.

• If the App fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligations with respect to the App.

• We, not Apple, are responsible for addressing claims by you or any third party relating to the App or your possession and/or use of the App, including product liability, legal compliance, and IP infringement claims.

• You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting,” and (ii) you are not listed on any U.S. Government prohibited party list.

• You agree to comply with applicable third-party terms when using the App.

• Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

If you prefer, you may rely on Apple’s Standard Licensed Application End User License Agreement (EULA); to the extent of any conflict, that EULA will govern your use of the App on Apple platforms.

16. Export & Sanctions Compliance

You may not use or export the App except as authorized by applicable law. You agree to comply with all export control and sanctions laws and regulations.

17. Age Requirements

The App is not directed to children under 13. If you are in the EEA, you must be at least 16 or have verifiable parental consent.

18. Severability; Waiver; Assignment

If any provision is found unenforceable, the remainder remains in effect. No waiver of any term is a further or continuing waiver. You may not assign these Terms without our prior written consent; we may assign them as permitted by law.

19. Governing Law & Dispute Resolution

These Terms will be governed by applicable mandatory consumer protection laws of your place of residence. Where permitted, disputes shall be resolved in the courts having jurisdiction over our principal place of business. Nothing limits your statutory rights.
